EDITORIAL POLICY
NO COMMERCIAL USE OF EDITORIAL IMAGES
Everett Collection allows images to be used for editorial purposes only. An editorial use of an image may only be used in connection with topics or events that are newsworthy. Examples of editorial use is the use of an image to illustrate a truthful topic in a newspaper, book, magazine, book, TV program or other media which the subject (the film, TV program, personality, historical event) is discussed, analyzed or critiqued. You may not use "editorial" images for any commercial, promotional, advertorial, endorsement, advertising or merchandising purpose. Editorial use requires a reasonable relationship between use of the visual images and the textual content. Biographies or documentaries are an example of appropriate editorial usage.
NO ALTERATION OF EDITORIAL IMAGES
Editorial images may only be cropped or otherwise edited solely for technical quality, provided that the editorial integrity of the image is not compromised, but may not be otherwise altered.
REPRESENTATIONS AND WARRANTIES
Everett Collection does not grant any right or make any warranty with regard to the use of names, people, trademarks, trade dress, logos, registered, unregistered or copyrighted audio, designs, works of art or architecture depicted or contained in the images. In such cases, you the user are solely responsible for determining whether release(s) is/are required in connection with your proposed use of the image and you are solely responsible for obtaining such release(s). You acknowledge that no releases are generally obtained for image identified as "editorial", and that some jurisdictions provide legal protection against a person's image, likeness or property being used for commercial purposes when they have not provided a release.
INDEMNITY
You agree to defend, indemnify and hold harmless Everett Collection and its officers, directors and employees from all damages, liabilities and expenses (including reasonable outside legal fees) arising out of or in connection with (i) your use of any image outside the scope of this argument; (ii) any breach or alleged breach by you (or anyone acting on your behalf) of any of the terms of this or any other agreement with Everett Collection; and (iii) your failure to obtain any required release for our use of the image(s).
Entertainment and historical images are not stock photos that rely on anonymous models (who have signed releases) to convey a feeling based on the subject of the photos. The subjects in entertainment and historical photos are generally well-known and care must be taken that the use of the photos relates to either them their work. The photos cannot be used in a commercial manner which implies that the subjects in the photo are endorsing a particular product, service, individual or company. Potential cover use must always be discussed with Everett in advance, as a cover must relate to the contents within the publication. Any questions regarding what may constitute an editorial use, please contact us to discuss prior to using any images. Regardless, it is the user's responsibility to understand the proper use of editorial images and to obtain any additional necessary rights.
